On an unpublished domain, now receiving junk emails from a business we have never heard of tends to suggest these people may have been assembling their own spamlist of domains using common aliases to send out Spam to

This banner is hilarious. It leads in turn to all the files on their server, including one of paricular interest called Clients.

Another banner leads here, an extraordinary site considering the presently reported activities.

Sorry... posted this in a new thread until I found this one.

The notorious former spam-king Brendan Battles who has been resident in NZ since 2006 (who screwed up with that one?) is spamming every NZ and AU address he can find. I received two of them yesterday.

This despicable prick has been served with an injunction by Yellow Pages after they discovered that he'd stolen their database. But he's ignoring that and continuing his disgusting practice.

If you get any emails offering you NZ and AU data, please report it to Internal Affairs. This guy needs to be whacked with a big stick.

NBR has an update. Apparently Yellow's lawyers haven't been able to locate Battles to serve the injunction. Although they have served one via email.

This case has taken a slight curve after an Australian Court has ruled that you can't copyright a phone book. If NZ Courts agree this could seriously affect the value of the Yellow / White Pages brands.

Raid Over Copyright Allegations criticised


A Yellow Pages Group copyright court case against a marketing database company heard submissions yesterday about an Internal Affairs Department raid on the alleged copyright violator.

Yellow Pages accuses Image Marketing Group of stealing its phonebook databases of about 315,000 businesses, information that it then allegedly sold on in its products.

Lawyers were in the High Court in Auckland before Justice Douglas White giving submissions on varying the terms of a previous injunction.

Toby Futter, counsel for IMG, Online Business Directory and principal Brendan Battles, said his client was fearful of his future with demands to break confidentiality of clients by coughing up their names and details to Yellow Pages.

He said Mr Battles had already had emails questioning media reports of allegedly stolen databases and a subsequent request for a refund from a client. One of the variations to the injunction sought to protect that confidentiality.

Mr Futter also told the court of a Internal Affairs raid on his client's business where personal property was ransacked and material seized.

"How did they [the plaintiff and counsel] know of the raid and what was taken ... how did information become known?" He spoke of his client's lack of faith and drew attention to "a government agency ... sharing information with counsel".

"This information [taken in the raid] should not be available in a civil suit. The Department of Internal Affairs should not have disclosed this information."

The court also spent time looking at the relevance of a recent Australian federal court ruling that determined there was no copyright on the White Pages or Yellow Pages produced by Sensis, Telstra's directories business.

Yellow Pages lawyer Kim McLeod said: "We're entitled to enforce our rights against another who infringes [upon our intellectual property]."

IMG's continuing activities were causing damage to his client. "The damage is ongoing and the plaintiff is entitled to know [the names and addresses sought] and if necessary come back to this court and deal with this."

Mr Futter said there had been no breach of copyright.

Mr Battles reappears flogging off data to Aussies. The following was sent to a Womens health centre in Port Hedland WA(!). So he's still raiding someones database

Battles' IMG Ltd offering "NZ postcode updates". Oddly the email says...

Interesting to see lawyer Kim McLeod’s name here (from AJ Park Ltd Auckland).

Well, interesting to see he is a lawyer for Yellow Pages.

I am a website designer and have watched with obvious interest as Yellow Pages book has become 1/4 of the size it used to be in the past years- that market spend has been eaten up by various online options

One would hope the downfall of Yellow book has not been the result of Kim McLeod's legal advice- lol. But most would agree I think that Yellow have certainly been the living/ breathing definition of a dying monopoly.

Who just happen to use the same lawyer as New Age Advertising Ltd who owns a website called newzealandgirls.co.nz- the largest online escort directory in the Country for those who like to pretend they have never heard of it (always very interesting to see the traffic/ stats on the http://www.sexykiwigirls.co.nz" onclick="window.open(this.href);return false; website- it follows office hours around Auckland CBD mostly- with distinct drops each time school holidays start ie) all Auckland CBD businessmen/ workers with families- lawyers even?

Prices on that website are among (if not) the most expensive in the Country- up to $150/week- not by choice of the advertiser of course.

So this lawyer Kim McLeod is a common denominator here it would seem.

I wonder if that has implications in regards the specialist law field "IP law and copyright" versus the theme of legal aid for monopolistic companies using IP law (amongst other things) in cases against incumbent’s and potential competitors.

I would be very interested to hear the outcome of the claim made by the Defendant's Counsel that there may have been inappropriate contact between Counsel for the Plaintiff and a government agency.

In the case being bought by New Age Advertising against the owners of this website – Kim McLeod chose to rely on an affidavit from ICIL Private Investigators (Auckland) in which they claim (after visiting all properties registered to the directors of our company and reportedly “harassing” residents and neighbours at those addresses- and eventually gaining illegal access to the apartment building occupied by our Company)- they “served” court documents on our Company by leaving them on the door step of a fourth floor balcony, then returned to their car and “witnessed” this Company’s director opening the door to the apartment from 200 metres away in their car, with a 20cm visibility angle in the pouring rain- an impossibility and thus outright dishonest. Counsel for the Plaintiff Kim McLeod presented that document to the High Court in Auckland and “relied” on it.

We do of course wonder- given the complaint detailed by NZX above, and our own experience with this lawyer- if perhaps more serious questions need to be asked as to his ethics.
