Escaped murderer recaptured in Brazil

UPDATED: Convicted paedophile and murderer Phillip Smith has been linked to Hawke's Bay as a director of a company that was registered to a Hastings address.
According to the Companies Office, Hastings man David Edlin had a 20 per cent share in the company and was also listed as a director. The company is listed on the Companies website as being struck off.
Mr Edlin is not suspected of any wrongdoing.
Police announced this morning that Smith had been recaptured in Brazil.
Police Commissioner Mike Bush made the announcement just after 4.30am, saying Brazil Federal Police had Smith in their custody.The New Zealand police liaison officer in Brazil visited Mr Smith and confirmed his identity.Mr Bush said the news of his capture would come as a relief to New Zealand and to Smith's victims. Mr Bush thanked the Brazil police, Interpol, and the New Zealand police investigation team for their excellent co-operation in this international manhunt.

Smith, 40, fled to Brazil via Chile last week while on temporary release from Springhill Corrections Facility in north Waikato.
He was jailed for life in 1996, after he stabbed an unnamed Wellington man to death as he tried to protect his young son, whom Smith had sexually abused.

Smith ran a mail-order business from prison, WSE Marketing, with Corrections approval until 2011.

He had completed accounting and business degrees behind bars. Smith, who is registered as a director under his birth name Philip Traynor, is also listed under the same Hastings address as Mr Edlin.

Mr Edlin has repeatedly refused to speak to Hawke's Bay Today. Approached at his residence yesterday, he said: "The only people I'll speak to have a uniform and a badge. If an investigation is under way, that's for them to handle."


The sister of Smith's murder victim, Lynda, this week said she suspected Smith may have left the country with far more than the $10,200 he declared at Customs, saying: "He made a whole lot more than that in his import company from prison."
Police said yesterday they were building a clearer picture of the events leading to Smith's escape.

They had spoken to a number of people who interacted with Smith in the past few months, and had also spoken to a lawyer yesterday, who confirmed he was representing Smith.

A search warrant had been executed on a Palmerston North address where a number of items were taken away for examination.
A search warrant was also executed on a safety deposit box in Auckland.

New Zealand Police liaison officer, Detective Superintendent Mike Pannett, has arrived in Rio de Janeiro where he will begin co-ordinating with Brazilian authorities.

Smith is due to release a comprehensive media statement today, which is expected to include an outline of his reasons for escape and an apology to his victims.

Meanwhile police have laid fresh criminal charges against Smith following his escape.

Documents at Auckland District Court show the 40-year-old was charged with escaping the custody of Corrections. A warrant for his arrest has been issued.

The maximum penalty for the offence is a jail term of five years.

"Having been convicted for an offence, namely murder, escaped from the lawful custody of Spring Hill Corrections facility in whose custody he was under the said conviction," the charge sheet said.

Smith responded to emailed questions from his South American hideout, telling Radio New Zealand that the outcome from his latest parole hearing spurred his escape.

He said his escape was "moderately hard and took longer than I would have liked" and that he was able to fund his escape by using his education in accountancy and finance behind bars. Smith said he hoped to remain in Brazil indefinitely and had no plans to ever return to New Zealand.

I was reminded of the "upskirt footage" of one David Overend, who attached a tiny camera to his shoe so he could photograph up the skirts of more than 2000 girls and women before he was caught in 1997.
Back then, Overend had to take his images home to process before he could trade them by email and through internet newsgroups. Today he could do it on the fly.

And to show that Kiwi ingenuity is still alive and well, Auckland man David Overend declared himself the "numero uno hidden cam jockey in New Zealand". His achievement? Developing a tiny pin-hole video camera for the toe of his sandshoe which he angled under the clothing of thousands of unsuspecting girls and women.

The 36-year-old pleaded guilty to nine charges under the Films, Videos Publications Classifications Act 1993 and was jailed for 21 months, fined $7000 and denied access to computers.

Perhaps the Police should review whether they should look further at Edlin's activities post-release from jail ? ;-)

While certain government departments have a lot to answer for in this case, there is a certain irony in Smith/Traynor's speedy recapture by the Brazilian Police.

Hawke's Bay Today investigation

A Hastings man who formed business ties with escaped paedophile and murderer Phillip Smith after they met in prison, also has convictions for making and distributing offensive material.

David Overend, now David Edlin, met Smith behind bars after he was imprisoned for 21 months for making and distributing offensive material.

In November 1997 Mr Edlin was sentenced in the Otahuhu District Court by Judge Cecile Rushton.

He had fitted a pin-hole camera in the toe of his shoe and filmed up thousands of women's and girls' skirts.
The court heard he had a history of sexual perversion dating back to teenage visits to swimming pools and was unlikely to overcome his urges.

Mr Edlin targeted public events in the central North Island, including the Hawke's Bay A and P Show, races at Hastings and other events.

The judge said his sexual deviancy started in his mid-teens at a Napier swimming pool and he then became a peeping tom.
He used his internet website to trade his footage and also advertise his life story.
On his homepage he boosted about when he got bored with his shoecam he put the pinhole camera into the bath mat at a youth hostel.

Edlin is his mother's maiden name. Mr Edlin changed his name from Overend some time after his release.


Smith, 40, was arrested by Brazil Federal Police yesterday morning (NZ time) after someone at the Rio de Janeiro hostel he was staying in recognised him from a news report and alerted authorities.

He had fled to Brazil via Chile last week while on temporary release from Spring Hill Corrections Facility.
He was jailed for life in 1996 after fatally stabbing an unnamed Wellington man as he tried to protect his young son, whom Smith had sexually abused.

Smith ran a mail-order business from prison, WSE Marketing, with Corrections approval, until 2011.
He had completed accounting and business degrees behind bars.

Mr Edlin yesterday confirmed he had used the name David Overend and that he had met Smith in prison.

"I spent a short time in prison about 17 years ago. Both [my partner] and I have known [Smith] for a long, long time. I've pretty much kept my nose clean for the last 17 years."

According to the Companies Office, he had a 20 per cent share and was also listed as a director in a company with Smith.
Mr Edlin, who is not suspected of any wrongdoing, claimed he had nothing to do with Smith's escape to South America and said he has no regrets about making money with the killer and child molester.

"He was conducting a lot of business that didn't have anything to do with me," Mr Edlin said.

"I believe that all that money that he had on him was legitimate." Smith, registered with the Companies Office as Phillip Traynor, owned 80 per cent of shares in WSE.

Mr Edlin said the business revolved around imported Chinese goods sold online.

"It was done right under the noses of Corrections."
He said the business involved sending "paperwork back and forth" and was operating legally with Corrections approval. Corrections monitored the paperwork and company transactions.
"We've had our business records audited by Inland Revenue and came out clean as a whistle."

Mr Edlin said Smith's decision to escape defied reason. "If you've got six months to your next parole hearing, when you could be released, why would you do that?"

He knew Smith from "way way back".
He said his friend's crimes in the 1990s, which included child molestation and murder, were despicable, but he had changed since then.
"I'm not condoning what he did. What he did was horrible. He was an absolute little s*** when he was a young man."
The company was struck off last November, a year after its last annual return was filed by Traynor, and more than two years after it was revealed that the business was being run from behind bars.

Corrections ordered a review in 2011 after it was discovered there were no laws preventing Traynor, an inmate at Paremoremo Prison, from conducting the activities, media reported at the time. He was importing products from Hong Kong with Mr Edlin, and his role was supplying advice and accountancy support by phone, mail and via face-to-face prison visits.

It was those business activities that earned Smith the funds to flee NZ, and with which he was paying just $50 a week towards the tens of thousands of dollars he owed as reparation to his victims.

When the company was registered, both men used the same Hastings address that Mr Edlin currently owns.

After Smith's arrest yesterday, Brazilian journalist Alexandre Tortoriello said the fugitive had told everyone he was an Australian citizen. "People said he was very convincing," Mr Tortoriello said.

"[The hostel] is very afraid of him being released and coming back here, so they won't tell anyone their name.
"Until the federal police give a statement we don't know if he is just being questioned and will be released, or whether he has been arrested."

"Smith was using the name James Paul Andrews while he was at the hostel.

"It's not clear yet whether he will remain in custody or not because we don't know the legal grounds of the detention."
Mr Tortoriello told the New Zealand Herald Smith had slept in a six-bedroom dorm with three others.
He tried to convince one of his roommates to drive him to Sao Paulo to go sightseeing, Mr Tortoriello said.

Smith has been remanded in custody for 60 days.

Revealed: Phillip Smith's $25K blackmail bid that ended in suicide


Phillip Smith tried to extort $25,000 from a man who later killed himself, court documents reveal.

Judicial files released to NZME. News Service today show that Smith tried to blackmail his victim while he was on bail following child sex abuse charges.

Smith, who was arrested in a Brazilian hostel yesterday after less than a week on the run, was arrested on September 12, 1995 after a boy told his family that Smith had been sexually abusing him over a three-year period.
Some time between September 28 and October 10 of that year, Smith embarked on his blackmail bid. His victim's response was to leave information for police before killing himself.

Smith was arrested on October 11 for attempted blackmail but was later released.

While on release Smith tracked down the family of the boy he abused and on December 11 stabbed the boy's father to death in the front of the whole family.

According to charge sheets related to the blackmail plot, Smith "threatened to make a disclosure about [the victim] of sexual misconduct, namely sexual indecencies".

During Smith's sentencing in April 1996 for blackmail - three months before his trial on the murder and abuse charges - Justice Paul Neazor said: "The consequences of what you have done have been great. The man you threatened is dead.

"Another person who worked with him has found his position financially and emotionally severely harmed."

Justice Neazor jailed Smith for two and a half years. He said the crime was done "callously for gain" and highlighted the significance of the fact Smith was on bail for the sexual offending at the time.

"You simply destroyed this man's peace of mind and were content to cause whatever followed for the sake of making some substantial gain," he said,

Smith faced the blackmail charge along with two other people but their identities, as well as that of the victim, were permanently suppressed by Justice Neazor.

The charges against the other two were later dropped.

In the judgment it was also revealed Smith had some 20 convictions for previous offending, which involved dishonesty, wilful damage and assault.

the warehouse full of Secondhand Household Goods (with more coming in)
or the fancy Chinese Imported Pillboxes that you haven't been selling many
of lately on TM haven't been financed from the PROCEEDS OF CRIME ? ;-)


After all, where does a freshly released Jailbird with no money to their name get the
readies to fund all those things in a mere 10 or 15 years (unless Winz happen to have
been extra generous) ? ;-)

Wendy Thew is being investigated by retirement village Mary Doyle Lifecare, after it was discovered a fax machine there was used to register WSE Marketing in 2008.

The company was set up by Smith and Mr Edlin, who met in prison.

The Hastings man ran WSE Marketing with Smith from 2008 to 2011. He said the business was just one of several sources of "legitimate income" available to the murderer.

A Mary Doyle Lifecare spokesman said the company was investigating the WSE Marketing issue and examining Ms Thew's contract to see if she had breached her employment conditions by sending or allowing the documents to be sent from the facility.

Woman charged with helping Phillip Smith escape


A woman has been charged with assisting murderer and paedophile Philip John Smith to flee the country last year.
A 33-year-old woman from Palmerston North had been summonsed to appear in the Auckland District Court on February 24 to face a charge of assisting him to escape lawful custody in November, police said.

The charge falls under Section 121(1)(b) of the Crimes Act and carries a maximum prison sentence of seven years, Auckland city police district commander Superintendent Richard Chambers said.

Smith was caught in Rio de Janeiro on November 13 a week after allegedly fleeing New Zealand while on temporary release from Spring Hill Corrections Facility in South Auckland, where he was serving a life term.

In 1995, he stabbed to death the father of a boy he had been sexually abusing, after tracking the family down to a Wellington house where they had moved to escape him.

Smith was on bail at the time for the sexual offending and charges of blackmail against a man who later killed himself.
